ARTICLE 2 APPLICATION OF THE CONDITIONS DESCRIBED IN THIS DOCUMENT
These general terms and conditions of sale govern the contractual relationship between WE ARTISTS and its customer, both parties accepting them without reservation. This is a contract for the sale of products via distance selling on the WE ARTISTS website. These general terms and conditions are fully accepted by the customer and applicable to any order placed on the site and shall prevail over any other terms and conditions of sale.
ARTICLE 3 - DATA PROTECTION ACT
In accordance with law no. 78-17 of January 6, 1978, the processing of this personal information has been declared to the Commission Nationale de l'Informatique et Libertés (CNIL). The consumer has a right of access and rectification at all times, which he may exercise by contacting WE ARTISTS.
The information collected for the purposes of distance selling is obligatory, as this information is essential for the processing and routing of orders and the preparation of invoices. The customer consents to the use of the personal data collected under the terms of the present order for the WE ARTISTS customer file.
ARTICLE 4 - APPLICABLE LAW
This contract is governed by French law, and by distance selling regulations (articles L 121-16 to L121-20 of the French Consumer Code) incorporating Directive 97/7 EC of May 20, 1997 on the protection of consumers in respect of distance contracts.
ARTICLE 5 - ORDER ACCEPTANCE
The buyer will receive an e-mail containing the details of the order.
ARTICLE 6 - VALIDITY
The offers presented on the site are valid while they are online.
ARTICLE 7 - GENERAL OBLIGATIONS OF THE PARTIES
dWE ARTISTS bonds :
WE ARTISTS undertakes, after confirmation of the order and validation of the payment, to provide an email summarizing the order and the conditions of access to the service.
WE ARTISTS reserves the right not to accept an order in the event of force majeure and undertakes to inform the customer.
Customer obligations :
By placing an order, you agree to accept delivery of the products and to pay the price, and more generally, to comply with these terms and conditions of sale and the laws applicable in your country of domicile or, if different, in another country.
Under no circumstances may the customer resell all or part of these products.
Any order placed by a customer is exclusively intended for his/her personal consumption or for the personal consumption of the person on whose behalf the delivery is to be made.
ARTICLE 8 - PRICES
WE ARTISTS reserves the right to change prices in the event of exceptional circumstances beyond its control. The prices indicated on the site are in Euros and include VAT.
ARTICLE 9 - PAYMENT
Orders are paid for before delivery. Payments are made online on the site by :
- credit card (Carte Bleue, Visa, Eurocard, Mastercard) securely through the Société Générale secure payment terminal. According to the technical characteristics of both the SSL space and Société Générale's encryption software, the information provided by the purchaser cannot be intercepted by a third party. Information entered by the customer is encrypted and will not circulate unencrypted on the Internet. The order will only be validated by WE ARTISTS once Société Générale's bank server has authorized the transaction.
ARTICLE 10 - AVAILABILITY
All orders will be processed while stocks last. If products are not available after you have placed your order, we will inform you by e-mail within 24 hours (working day).
You may then request the cancellation of your order or the exchange of the product(s) concerned.
ARTICLE 11 - ORDER FULFILMENT
WE ARTISTS will only deliver the products ordered once the customer's bank has approved the payment.
Article 12 - DELIVERY
Delivery will be made to the address indicated by the customer. In case of absence, a notice will be given. WE ARTISTS cannot be held responsible for any deterioration of the products due to the late reception of a parcel caused by the absence of the customer or the person entitled to receive it.
A delivery charge is added to the customer's basket.
Deliveries are made by carrier.
Article 13 - CLAIMS
The products delivered have been the object of rigorous care in order to preserve the perfect conservation of the products.
In the event of damage, you must express any reservations in writing within 24 hours. Explanations must be precise and detailed. In the event of non-receipt of the order, the customer must also notify WE ARTISTS within 24 hours.
You may then request the cancellation of your order or the exchange of the product(s) concerned.
Article 14 - GUARANTEES
WE ARTISTS guarantees that the products comply with current legislation.
WE ARTISTS will refund the product(s) in the event of quality deterioration.
Article 15 - CANCELLATION
In accordance with the provisions of article 121-20 of the French Consumer Code, the customer has a period of 14 clear days from delivery to return the parcel in its original packaging, unopened, with the seals intact and in perfect condition, for exchange or refund, the return costs being borne by the customer.
Article 16 - SETTLEMENT OF DISPUTES
Complaints will be processed within eight days of receipt.
